AGB Zusatz

1. Betreffend Hygiene- und Verhaltensmassnahmen des Bundesamtes für Gesundheit (BAG) wird vollumfänglich auf das Schutzkonzept des SFV und dessen Anhänge verwiesen. Sowohl das Schutzkonzept, dessen Anhänge bilden integralen Bestandteil des vorliegenden Haftungsausschusses.

2. Der Haftungsausschluss gilt für alle Anwenderinnen des Branchen-Schutzkonzeptes, also für Fahrlehrer/ -innen, Fahrschulen, Ausbildungsstätten sowie den SFV selbst (nachfolgend wird aus Gründen der Praktikabilität von Fahrlehrern die Rede sein).

3. Die Teilnahme am Fahrunterricht erfolgt auf eigene Gefahr. Dieser Haftungsausschluss ist integrierter Bestandteil der AGB.

4. Die Schutzmaterialien werden durch den Fahrlehrer am Anfang jeder Fahrlektion ausgehändigt. Ist es Fahrschüler (K) nicht möglich Hygenemasken zu tragen, kann „K“ bewusst darauf verzichten mit Absprache Fahrlehrer (somit erhöht sich das Risiko einer allfälligen Ansteckung) welches „K“ bewusst ist (gemäss contact tracing Verordnung) werde diese Daten separat gespeichert.

5. Sollte „K“ einer Risikogruppe anghören, muss „K“ seinen Fahrlehrer darauf aufmerksam machen, dass „K“ eine FFP-2 oder FFP-3 Maske tragen muss. Dieses Material bringt „K“ selber mit zur Fahrstunde oder verzichte auf eine Fahrstunde gemäss BAG (Risikogruppen).

6. Ich nehme zur Kenntnis, dass der SFV und der Fahrlehrer keine Verantwortung im Zusammenhang mit einer Infektion mit dem neuen COVID-19 Virus oder Varianten davon übernehmen. Der SFV und der Fahrlehrer können in keiner Form für die Ansteckung und jegliche damit zusammenhängenden Folgen oder Nebeneffekten haftbar gemacht werden.

7. Im besonderen nimmt „K“ zur Kenntnis, dass gewisse Hygiene- und Sicherheitsvorschriften und Empfhelungen während, vor und unmittelbar nach dem Unterricht, entweder temporär oder über die gesamte Unterrichtszeit, nicht eingehalten werden können.

8. Insbesondere nimmt „K“ zur Kenntnis, dass der Fahrlehrer die momentane 2m-Distanzregel und auch allfällige zukünftige Distanzregeln nicht oder nicht während der gesamten Dauer des Unterrichts einhalten kann. „K“ ist bewusst, dass dies aus technischen Gründen nicht möglich ist.

9. Sofern „K“ nicht gegen Unfälle oder Krankheiten, welche im Rahmen des Fahrunterrichts oder auf dem Weg dorthin, entstehen bzw. ausbrechen, versichert ist, trägt „K“ dafür die volle Verantwortung.

10. „K“ verhält sich auf dem Weg hin / zurück, zur Fahrstunde an die Weisungen des BAG..

4. The protective materials are given by the driving instructor at the beginning of each driving lesson. If it is not possible to wear hygiene masks for learner drivers (K), "K" can consciously do without this by informing driving instructors (this increases the risk of contagion), which "K" is aware (according to the contact tracing regulation) this data will be stored separately.

5. Should the learner (K) belong to a risk group, "K" have to inform his driving instructor aware of this, that "K" have to put on an FFP-2 or FFP-3 mask. "K" bring this material with to the driving lesson or do without an driving lesson according to the BAG (risk groups).

6. "K" has understood, that the SFV and the driving instructor assume no responsibility in connection with an infection with the new COVID-19 virus or variants thereof. The SFV and the driving instructor can in no way be held liable for the contagion and any related consequences or side effects.

7. In particular, "K" knows that certain hygiene and safety regulations and recommendations, before during and after the lesson, either temporarily or for the entire lesson time, it's not possible to fulfill.

8. In particular, "K" attention that the driving instructor is aware of the current "2m" distance rule and any future distance rules can or cannot comply with the entire duration of the lesson. „K" is aware that this is not possible due the technical affairs.

9. If "K" hold not an insurance about accidents or illnesses that occur during driving lessons or on the way there, arise or brake out, "K" took the risk fully at itself.

10. On the way and back, for the driving lessons, "K" behave to the instruction of BAG.
